Check-in/Check-out Policies

This property has the following check-in and check-out times and policies:

Check-In: 4:00 PM

Check-Out: 11:00 AM

Late Check-out Hour: 1:00 PM

Late Check-out Fees: $300.00

Late check-out (after 11:00 AM and before 1:00 PM) may result in a fee.

Property and Cancelation Policies :

Guest may cancel this reservation with a written notice ofcancellation. The cancellation date is the date that the written notice isreceived by The Galvan Estate. Should Guest cancel his/her reservation at least 60days prior to the date of check-in articulated above, all amounts paid will beforfeited (less Guest’s security deposit, if already paid). If he/she cancels more than 60 days in advance ofcheck-in, one half of all amounts paid will be refunded. 


Terms and Conditions

 1.         The GalvanEstate’s owners, agents, and representatives have the right to inspect thepremises without any prior notice, at any time to enforce the terms of this Agreement. Should the Guest and/or her guests violateany terms of this Agreement, the rental period shall immediatelyterminate. There will be no refunds forany unused portion of Guest’s stay.
2.         Guest maycancel this reservation with a written notice of cancellation. The cancellationdate is the date that the written notice is received by The Galvan Estate.Should Guest cancel her reservation at least 60 days prior to the date ofcheck-in articulated above, all amounts paid will be forfeited (less Guest’ssecurity deposit, if already paid). Ifshe cancels more than 60 days in advance of check-in, one half of all amountspaid will be refunded.                                                                                                                                                                                                                                                               
3.         Guest is anadult 25 years or older, which will be verified at check-in, and will be anoccupant of The Galvan Estate during theentire reservation period. 
4.         Guest willhave 
no more than eight (8) individuals,including himself, stay overnight at the premises. Further, there shall be no more than twelve (12) individuals on the premises at any given time,except for during any event for which an event permit has been acquired by TheEstate from The City of Palm Springs. Use of the premises will be denied to any individuals not within one ofthese two categories.                                                                                                                                     
5.         Guestagrees that there will be NO PARTIES at the location unless specifically agreedto by The Estate, AND a city event permit is obtained in advance. Guest’s circumvention of this policy willresult in an automatic termination of this Agreement, and Guest will be askedto immediate vacate the premises. TheEstate will not refund any portion of any amounts paid should Guest be asked tovacate the premises.                                                                                                                                                                                                                                     
6.         Guestswill be required to vacate the premises, and forfeit the rental fee andsecurity deposit for any of the following violations:·Occupancy exceeding the sleeping capacity stateherein;Using the premises for any illegal activityincluding, but not limited to: the usage of any illegal substances, and thepossession, serving, or consumption of alcoholic beverages by or to any personsunder the age of 21;·      Causing damage to the premises or any of theneighboring properties;·Violation of the Palm Springs noise ordinance; Any acts which interfere with the neighbors’right to quiet enjoyment of their property; and Any disturbance or interference that requiresthe intervention of the Palm Springs Police Department.
7.         Guest andmembers of Guest’s party will behave in a civilized manner and will be goodneighbors, respecting the rights of the surrounding property owners, whilerefraining from creating noise or disturbances. 
The City of Palm Springs strictly enforces a noise ordinance rule,which prohibits amplified music outside. Further, all outside activities must end no later than 10:00pm, unlessspecified otherwise with a Palm Springs event permit. Guest will be responsible for any finesearned for failure to abide by the noise ordinance. A noise disturbance of the nature describedherein, and enforced by the Palm Springs noise ordinance, will be grounds forthe immediate termination of Guest’s stay. There will be no refunds in the event Guest’s stay is terminated.   In the event the City of Palm Springs issues a noisecitation, Guest will be charged a fee of $5000 to cover the costs associatedwith the citation.                                                                                                                                                                                                                                     
8.         Guest shallnot sublet the premises.
9.         Guestexpressly acknowledges that this Agreement is for the transient occupancy ofThe Estate, and Guest does not intend to make the premises a residence orhousehold.
10.       There willbe NO SMOKING on the premises of The Estate. Any evidence of smoking on thepremises will result in a full forfeiture of the security deposit.                                                   
11.       NO ANIMALS OR PETS are permitted on the premises.
12.       Guest will maintain The Estate in a good, clean condition, and will only use it in a lawful manner. Guests will leave the premises in broom swept condition at the expiration of this Agreement. 
13.       Guests willbe responsible for any damage done to the premises and its furnishings, over andabove normal wear and tear. Guest agreesthat The Galvan Estate can deduct any and all costs for such damage from thesecurity deposit, or Property Damage Protection, if it has been purchased. Any damage that cannot be adequatelysatisfied with the security deposit, or Property Damage Protection, will becharged to Guest’s credit card. TheEstate does not waive its right to avail itself of any remedy available, to thefull extent of the law, to ensure that any and all damages are remedied.
14.      Guest agreesto notify The Estate within 24 hours of any housekeeping complaint or propertymaintenance issue. Failure to do soexpressly precludes Guest from any courtesy consideration. Further, if the premises are damaged due tofailure to report a maintenance issue, Guest will be held responsible for anysubsequent damages.
15.       Guest agreesthat the air conditioning will not be set below 72 degrees, and heating willnot be set above 84. Doors and windowsmust be closed when either the heat or air conditioning is in operation. Guests must turn off all appliances upondeparture. 
16.       Guest mustdispose of all waste material generated during the rental period in a lawfulmanner.  Trash bins are located on theeastern side of the house. The house managerwill arrive on Tuesday evening or Wednesday morning to prepare the trash binsfor trash collection. 
17.       Guestrecognizes the inherent danger of swimming pools. The pool at The Estate is not gated. Guest has a duty to warn all individuals in herparty of this danger. Guest and herguests hereby assume full responsibility for any and all injuries associatedwith having a pool on the premises, including, but not limited to: bodilyinjury, paralysis, and death. Thus,Guest will not allow children to be unsupervised while on the grounds of TheEstate.  Further, Guest will not allowanyone in her party to swim unsupervised. Guest understands that diving into the pool is unpermitted and will stopanyone in her party from doing so.  If guest has purchased pool heating, the temperature of thepool may not reach more than 85 degrees.                                                                                                                           
18.       The Estatehas a fire extinguisher under the island sink in the kitchen, as well as in theoutdoor bar. The fire extinguishers werefull at the last inspection of the premises. Guest must inform the house manager immediately in the event the fireextinguisher is discharged. The fireextinguisher must only be used for true emergencies.
19.       The Estatehas functional smoke and carbon monoxide detectors installed on thepremises. Guest will notify managementwithout delay, in the event a fire alarm “chirps,” or demonstrates indicia oflow battery conditions.
20.       Guest willsecure the premises, when prudent, and when not occupied, by locking doors,windows, garage doors, and setting the alarm. If the police are dispatched for a false alarm activation, Guest may becharged a fee up to $150.00.
21.       Guest willnot access the owner’s closet or pantry, even if unlocked.
22.       Items leftbehind by Guest will be held for Guest, and every reasonable effort will bemade to return any items to Guest. Anyitems not claimed after six months will become the property of The Estate. The Estate is not responsible for any itemsleft behind and their condition.
23.       There willbe no refunds due to shortened stays or ruined expectations due to weatherconditions, family emergencies, Acts of God, or other unforeseeable events.                                       
24.       Check-out isat 11am. A representative will bepresent at that time to retrieve the keys to The Estate and to secure thepremises. Guest will be charged $300 perhour she is late checking out.               
25.       The Estatehereby does not expressly warrant that the cleaning practices instituted on theproperty prevent the spread of COVID-19, or any other virus and bacteria-borneillness.  If Guest or any members of her party believe that they mayhave contracted a contagious disease while in the City of Palm Springs, Guestagrees to immediately have all members of her party wear a mask while at TheEstate and contact The Estate’s management. The Estate will assist Guest will plans to safely leave thepremises.                                                                                                               
26.       Guest andmembers of her party shall hereby indemnify and hold harmless The Estate, andits agents and representatives, against any and all claims of personal injuryincluding injury, death, illness, property damage or loss arising from the useof the premises, regardless of the nature of the accident, injury, orloss. Guest expressly acknowledges thatany insurance for property damage or loss, which The Estate may maintain, doesnot cover the personal property of Guest. Guest should purchase her own insurance, if such coverage isdesired. 
26.       The terms ofthis Agreement are applicable to Guest and anyone in Guest’s party, or whomGuest may invite to The Estate during her stay.
27.      Guest agreesto pay all reasonable costs, expenses, and attorney’s fees associated with theenforcement of this Agreement.
28.       Guest agreesto submit any and all claims or controversies arising out of or in any wayrelating to this Agreement to final and binding arbitration before a neutralarbitrator, and not to any court, in Riverside County, California. Both partiesexpressly waive any right that either party has or may have to a jury or benchtrial of any dispute arising out of, or in any way related to, this Agreement.
29.       This Agreementshall be binding upon and inure to the benefit of, and shall be enforceable byand against, the successors, heirs, assigns, beneficiaries and legalrepresentatives of Guest and members of her party. It is agreed that the rights and obligationsof Guest may not be assigned or delegated except as specifically set forth inthis Agreement.
30.       This entire Agreementshall be construed in accordance with and governed by the laws of the state ofCalifornia.
31.       ThisAgreement may only be modified in writing. 
32.       ThisAgreement may be executed in counterparts and each counterpart, when executed,shall have the validity and enforceability of an original. Photographic orfacsimile copies of any signed counterparts may be used in lieu of the originalfor any purpose.
33.      ForceMajeure. The performance of The Estateunder this Agreement is subject to force majeure, including but not limited toacts of God, fire, flood, natural disaster, war or threat of war, acts orthreats of terrorism, civil disorder, unauthorized strikes, governmentalregulation or advisory, recognized health threats as determined by the WorldHealth Organization, the Centers for Disease Control, or local governmentauthority or health agencies (including but not limited to the health threatsof COVID-19, H1N1, or similar infectious diseases), or other similar occurrencebeyond the control of The Estate, where any of those factors, circumstances,situations, or conditions, or similar ones, prevent or dissuade The Estate fromoperating or opening its property, or while any of them make it illegal,impossible, inadvisable, or commercially impracticable to operate or open theproperty or to fully perform its obligations under this Agreement. In any suchevent, The Estate shall not be held responsible for not complying with theterms of this Agreement nor opening or operating its property during, or underthe threat of, such act or event, and shall be able to keep closed and safe itsproperty, or modify its property calendar without liability, damages, fees, orpenalty.
